US announces Second H-1B Visa Lottery for FY 2025 Amid High Demand

The U.S. Citizenship and Immigration Services (USCIS) has announced a second lottery for H-1B visa applications for the fiscal year (FY) 2025. This follow-up lottery comes as the initial selection process did not fully utilize the numerical allocation for the regular H-1B cap, creating additional opportunities for visa applicants.

The initial lottery, held in March, allowed eligible registrations for both the regular H-1B cap and the advanced degree exemption, known as the master's cap. Selected individuals from this first round were permitted to submit their H-1B petitions from April 1 to June 30, 2024. However, the number of petitions filed did not meet the required quota for the regular H-1B cap, leading to the need for a second lottery to fill the remaining slots.

Eligibility for the Second Lottery

The second round of the lottery will randomly select additional registrations from those who submitted their applications electronically during the initial period. This selection will include both individuals eligible for the regular cap and those who qualified for the master's cap. Notably, the second lottery will not extend to the master's cap, as the initial lottery already filled the 20,000 visas reserved for this category.

Understanding the H-1B Visa Program

The H-1B visa is a non-immigrant visa that allows U.S. companies to hire foreign workers in specialty occupations, including fields such as science and information technology. The annual cap for H-1B visas is set at 85,000, with 65,000 designated for general specialty occupations and 20,000 reserved for individuals with advanced degrees from U.S. institutions. Indian IT firms, including TCS, Infosys, and Wipro, are among the major beneficiaries of this program, utilizing it to bring in skilled workers each year.

How the Lottery System Works

Given the high demand for H-1B visas, which often exceeds the annual cap, USCIS employs a randomized lottery system to select applicants. Employers must submit a registration form detailing the employee's qualifications, job role, and salary offer. The lottery process is entirely random, with no consideration given to factors such as wage levels, skills, or employer requirements.

The upcoming second lottery provides another chance for applicants who were not selected in the first round to secure a visa and fill the remaining regular cap slots for FY 2025. This process aims to ensure that all available H-1B visa slots are utilized efficiently.
