An American judge sided with WhatsApp in its legal battle against Israel's NSO Group. NSO was implicated in taking advantage of a loophole in WhatsApp to sneakily install Pegasus, a spying software, on phones. This ruling is viewed as a victory for WhatsApp and privacy advocates; the court held NSO accountable. The judge declared NSO's act as hacking and contract breach.

Now, the next step is the trial to finalize NSO's penalty amount. No dates for trial have been assigned, and NSO hasn't commented on the verdict. Will Cathcart, WhatsApp's boss, appreciated this result for preserving privacy rights. He stated on social media, "We took five years to prepare our case; we hope spyware firms won't evade the repercussions of their unlawful activities.
They must acknowledge that it is incorrect to spy." The root of the case was WhatsApp's 2019 lawsuit. They blamed NSO for using an app defect to put Pegasus spyware on around 1,400 folks' phones. This included journalists, human rights workers, and government critics. NSO's clients, like government bodies, could access messages and locations covertly.
WhatsApp labeled this act as illegal. NSO insists its software only assists government bodies to maintain law and order. Their argument is that their tools contribute to national security. However, American courts haven't agreed. In 2020, they refused NSO's immunity request that would have saved them from liabilities. The 9th U.S. Circuit Court of Appeals agreed with this in 2021. NSO's last-ditch attempt in 2023 was quashed by the U.S. Supreme Court, leading to Friday's judgement. Privacy and cybersecurity experts hail this as a leap in the digital spying combat.
John Scott-Railton, from Citizen Lab who exposed Pegasus in 2016, called this ruling a landmark for the spyware trade. He further said, “This emphasizes NSO's role in law violations. Spyware firms can't claim innocence of tool misuse. This made it tough for them to conceal their deeds.” WhatsApp has mooted a court order to bar NSO's future use of its spyware.
While the trial now moves to determine NSO's due compensation, experts think this can set a precedent for holding spyware firms accountable. This verdict arrives at a time of growing concern about digital privacy and government snooping. Increased scrutiny is on companies selling hacking equipment to governments, as misuse by rogue states to harm innocent people, like journalists or activists, is a risk. While the NSO lawsuit is in progress, Friday’s verdict is perceived as a significant triumph for WhatsApp and a positive stride toward digital privacy.
