In a tragic case highlighting the consequences of strict abortion laws, Nevaeh Crain, an 18-year-old from Texas, lost her life after being denied critical medical care that could have saved her and her unborn child. Crain was reportedly experiencing severe complications during her pregnancy when her condition deteriorated on October 28, 2023, just a day before her planned baby shower.

Crain initially woke up with a headache and later developed a fever, accompanied by vomiting and nausea. Despite her discomfort, she managed to attend the baby shower, but her family decided to take her to the emergency room at around 3 PM. Her boyfriend, Randall Broussard, drove her to a local hospital, where they faced a long wait in the emergency room. For four hours, Crain was forced to sit with a plastic pan provided by the hospital staff as she continued to vomit.
After undergoing tests, Crain was diagnosed with strep throat but received no evaluation for her pregnancy. She was discharged with a prescription for antibiotics. However, later that night, her condition worsened, prompting her mother, Candace Fails, to take her to another hospital. There, an OB-GYN informed them that Crain had a high fever and was exhibiting signs of sepsis, which required immediate medical attention.
Despite receiving intravenous fluids and antibiotics, Crain's health continued to decline, and she was later discharged with a urinary tract infection. Just hours after returning home, she experienced severe bleeding and was rushed back to the hospital by 9 AM. In a heartbreaking turn of events, she began to miscarry, and an ultrasound revealed that there was no longer a fetal heartbeat.
Due to Texas's stringent abortion laws, doctors were unable to intervene decisively, as they could only act if Crain's life was in imminent danger. Dr. Tony Ogburn, an OB-GYN, commented on the restrictive environment in Texas, where healthcare providers often feel paralyzed by the fear of legal repercussions if they perform what could be considered an abortion.
Despite her deteriorating condition, doctors delayed performing a necessary procedure due to concerns about her bleeding and internal complications. Nevaeh's mother witnessed her daughter in extreme pain, pleading with the medical staff for help as Crain's health rapidly declined.
In the hours that followed, Crain succumbed to her complications in the intensive care unit, with medical experts suggesting that with appropriate care, she could have been saved. Following her death, Candace Fails has sought legal action against the hospitals involved, but she faces significant challenges due to Texas's legal framework that requires proof of "willful and wanton negligence" in emergency care cases.
Experts in health law have criticized the implications of such restrictive policies, arguing that pregnant women in states with stringent abortion laws are often left vulnerable and without adequate medical care. "Pregnant women have become essentially untouchables," said Sara Rosenbaum, a professor of health and law policy.
Health providers at the hospitals where Crain was treated have not issued any statements regarding the incident, leaving the family and community seeking answers and accountability for the tragic loss of Nevaeh Crain.
