South Korea’s special prosecutor is gearing up to call for a heavy sentence for former president Yoon Suk Yeol, who faces serious insurrection charges related to his brief declaration of martial law in late 2024. This development coincides with the lower court's final hearing held in Seoul on Friday, a pivotal moment in one of the nation’s most intense political trials in years.
The 65-year-old Yoon stands accused of attempting to orchestrate an insurrection by trying to suspend democratic principles and assume extraordinary powers via martial law. If found guilty, he could face life behind bars or potentially the death penalty under South Korea’s judicial system. Although capital punishment is still legally enforceable, the nation has not executed anyone since 1997, effectively maintaining an unofficial moratorium.
During the proceedings at the Seoul Central District Court, prosecutors contended that Yoon and his former defense minister, Kim Yong-hyun, were plotting the martial law declaration for months. The prosecution asserts that conversations about bypassing parliament and usurping legislative authority start as early as October 2023. This alleged strategy included framing political opponents as national threats to rationalize extreme measures in the name of security.
Moreover, prosecutors accused Yoon of intending to label significant opposition figures, such as then-opposition leader Lee Jae Myung, as “anti-state forces” to justify detaining them during the emergency rule. In a dramatic allegation, the prosecution claimed that Yoon and his team attempted to legitimize martial law by deliberately heightening tensions with North Korea through a covert drone initiative.
Even though the martial law was in effect for just about six hours, its ramifications were profound. This incident unsettled South Korea’s financial markets, raised alarms among international allies, and incited widespread fears regarding the stability of one of Asia’s oldest democracies. Lawmakers managed to annul the declaration by breaching security barriers at the National Assembly and voting for its revocation.
Yoon has persistently rejected all allegations, asserting that the constitution granted him the authority to impose martial law. He contends that his actions were meant to alert against what he termed relentless disruptions by opposition parties and were not intended to subvert democratic governance.
During Friday’s hearing, Yoon appeared noticeably thinner than during previous sessions, dressed in a somber suit while seated alongside his co-defendants, including Kim Yong-hyun. The session was devoted to concluding remarks from both the defense and prosecution, with sentencing recommendations anticipated shortly.
The court plans to announce its verdict in February. This ruling is expected to conclude a tumultuous chapter that began with Yoon’s impeachment, followed by a snap election that ultimately led to the emergence of Lee Jae Myung. Beyond this case, Yoon continues to confront more allegations, including abuse of power and hindering the execution of an arrest warrant.
