The amendment, which specifically bars discrimination based on factors such as “gender identity” and “pregnancy outcomes,” is being hailed as a significant step in safeguarding the rights of transgender individuals and those seeking abortion care. Supporters argue that this change will further cement protections for these groups within the legal framework of the state.
The vote on the amendment was closely watched, especially in light of the larger national conversation about abortion rights in the wake of the U.S. Supreme Court’s decision to overturn *Roe v. Wade*. Democratic leaders in New York strategically placed this amendment on the 2024 ballot, partly in hopes of boosting voter turnout among those passionate about defending abortion access. In a year where the U.S. House elections in New York could influence the balance of power in Congress, the amendment’s passage was seen as an opportunity to galvanize voters.

The amendment adds specific language to the state constitution that prohibits discrimination based on national origin, age, disability, sexual orientation, gender identity, gender expression, pregnancy, pregnancy outcomes, and "reproductive healthcare and autonomy." Prior to this change, the constitution already prohibited discrimination on the basis of race, creed, or religion. However, the new additions further expand the categories of protection for marginalized groups, including those seeking reproductive health services like abortion.
While the amendment has been largely celebrated by progressive groups, including the New York Civil Liberties Union, which applauded the state’s voters for standing against national efforts to roll back abortion rights, the move has been met with significant opposition from conservatives. Critics argue that the broad wording of the amendment could have unintended consequences, including giving transgender athletes the legal right to compete on women’s sports teams. Some opponents also voiced concerns that the amendment could extend civil rights protections to noncitizens, potentially leading to controversies such as voting rights for noncitizens or the possibility of parents losing the ability to make medical decisions for their children.
The debate over the amendment has highlighted the complicated nature of crafting laws aimed at safeguarding individual rights without overstepping into unintended legal territories. The New York City Bar Association, along with some legal experts, has supported the amendment's goal of providing a legal framework to challenge any future restrictions on abortion, framing these restrictions as unconstitutional forms of discrimination in medical care. However, the absence of the word “abortion” in the amendment has led to confusion and legal uncertainty. Supporters of the amendment argue that by making discrimination on the basis of reproductive healthcare illegal, it effectively shields abortion access, but the exact legal implications remain unclear.
The language of the amendment sparked significant debate, and the New York State Board of Elections even had difficulty drafting a simple, clear explanation of its implications. Instead of interpreting the amendment or including references to abortion, the board opted to repeat the text of the amendment verbatim on voters' ballots, which sparked dissatisfaction among some advocates. A judge declined to order the board to rewrite its explanation, citing the ambiguity of how the amendment would be interpreted in the future.
Despite the uncertainty surrounding the amendment’s impact on abortion, it is important to note that abortion is currently legal in New York up until the 24th week of pregnancy. After this point, abortion is only permitted in cases where the person’s life, physical health, or mental health is at risk, or if a medical provider determines that the fetus is not viable. This legal framework is unlikely to change anytime soon, as New York has a firmly Democratic-controlled state government, which has shown no interest in imposing new restrictions on abortion.
However, if future state lawmakers attempt to pass laws that restrict abortion access or limit gender-affirming medical care for minors, supporters of the amendment believe that it could provide strong legal protection. Unlike ordinary state laws, constitutional amendments require passage by the legislature in two consecutive sessions and final approval from voters, making them much harder to repeal. This means that the amendment could potentially act as a legal safeguard against any future rollback of abortion rights or transgender protections in New York.
