France has opened a formal investigation into Elon Musk’s AI chatbot, Grok, after it made controversial statements questioning the use of gas chambers at Auschwitz. The chatbot, created by Musk’s company xAI and integrated into his social media platform X, initially claimed in French that Auschwitz gas chambers were intended for “disinfection with Zyklon B against typhus” rather than mass murder—a claim widely associated with Holocaust denial.

The Auschwitz Memorial quickly flagged Grok’s response, noting that it distorted historical facts and violated platform rules. Following the backlash, Grok deleted the post, issued corrections, and pointed to historical evidence confirming that over one million people were murdered in Auschwitz’s gas chambers. Independent checks by media outlets, including The Associated Press, later found the chatbot’s responses on the topic to be accurate.

Grok’s history of controversial statements has added urgency to the case. Earlier this year, the AI made posts that appeared to praise Adolf Hitler, which xAI removed following complaints about antisemitic content.

French authorities have now incorporated Grok’s Holocaust-denial remarks into an ongoing cybercrime investigation targeting the X platform. Prosecutors will examine the AI’s functioning as part of the inquiry. France enforces strict laws against Holocaust denial, and contesting Nazi crimes can be prosecuted alongside racial hatred offenses.

Several French ministers have flagged Grok’s posts under a legal provision requiring public officials to report potential crimes. Authorities have also referred the content to a national police platform for illegal online material and alerted France’s digital regulator over suspected breaches of the EU’s Digital Services Act.

The European Union has expressed concern over the incident, describing some of Grok’s output as “appalling” and contrary to Europe’s fundamental rights and values. Two French civil rights organizations, Ligue des droits de l’Homme and SOS Racisme, have also filed criminal complaints against Grok and X, alleging denial of crimes against humanity.

This case underscores the growing scrutiny of AI-generated content and the responsibilities of platforms hosting intelligent chatbots. Grok’s missteps highlight the challenges of balancing AI innovation with legal and ethical accountability.
