Air Canada Overturns Ruling on $2,079 Baggage Claim

Air Canada has successfully challenged a ruling from the Canadian Transportation Agency (CTA) requiring the airline to compensate a passenger $2,079 for delayed baggage.

Federal Court Justice Michael Manson found the 2024 decision lacked reasonableness and ordered the case to be re-evaluated by a different CTA official.

The issue began in 2022 when Alaa Tannous and his spouse traveled from Toronto to Vancouver, facing a delay in their checked luggage which arrived a day late. Initially, Air Canada proposed a $250 compensation, leading the couple to seek a more substantial payout.

Air Canada asserted that the CTA’s award was too generous, highlighting that several purchases included luxury items or were made after the luggage's return. Justice Manson concurred, stating that the ruling did not sufficiently clarify why expenses incurred post-delivery related to the delay.

Tannous provided receipts totaling $3,435; however, only $1,691.98 represented costs incurred before the baggage arrived. Among the post-delivery purchases were a $433.61 pair of sneakers and a $1,310.40 monogrammed luggage piece. Tannous explained that the sneakers were bought unaware of the luggage’s return, while the suitcase was intended to transport replacement items.

The court highlighted the necessity for the new CTA officer to conduct a rigorous assessment of the claim, determining what qualifies as reasonable expenses for delayed baggage.

According to prevailing regulations, both passengers and airlines have the right to appeal CTA rulings to the Federal Court to determine the fairness of compensation decisions.
