A New Jersey woman has filed a lawsuit against American Airlines, alleging that the airline failed to protect her from a sexual assault by a fellow passenger during a flight. The lawsuit, reported by The Independent, claims that the incident took place on August 26, 2022, during a nighttime flight from Charlotte, North Carolina, to Newark Liberty International Airport.

The woman, who has chosen to remain anonymous, contends that American Airlines is liable for not ensuring her safety and well-being while on board. According to the lawsuit, shortly after takeoff, the woman fell asleep and awoke to find a man seated next to her engaging in a sexual assault. The lawsuit describes a disturbing scene where the man's arm was inside her pants, and his hand was forcing hers onto his genitals while he covered them both with his black puffer jacket.
The woman, described as being paralyzed with shock and panic, then endured further assault as the man attempted to penetrate her. She managed to push him away, at which point he returned to his seat, ending the immediate assault. The lawsuit states that the perpetrator later tried to downplay the situation by offering the victim water while holding her hand, only ceasing when he saw a flight attendant approaching.
After the incident, the victim alerted a flight attendant and was moved to another seat for the remainder of the flight. Upon landing, the perpetrator was escorted off the plane, and statements were collected from the victim and witnesses. However, it remains unclear if the perpetrator was taken into custody or charged with sexual assault.
The woman's attorney, Brian Andris, expressed his intent to seek justice for his client, emphasizing the severe emotional and psychological impact of the assault. “As alleged in the complaint, we look forward to seeking justice on behalf of our client to remedy this terrible injustice for all that she has suffered,” Andris said.
American Airlines responded to the lawsuit by stating they are reviewing the details of the case. “The safety and comfort of our customers is a top priority for American,” said a spokesperson for the airline.
The lawsuit also highlights a broader issue, citing an increase in in-flight sexual assaults, with the FBI reporting 96 cases in the previous year. It argues that American Airlines had a clear duty to ensure the safety of passengers and accuses the airline of breaching this duty by failing to monitor the cabin adequately, prevent the assault, and intervene promptly.
The legal action underscores ongoing concerns about passenger safety and the responsibilities of airlines to address and prevent in-flight violence.
