Shortly after Luigi Mangione was detained at a Pennsylvania McDonald’s on December 9, 2024, investigators conducting a search of his backpack uncovered a loaded gun magazine cleverly hidden within a pair of underwear. This crucial find links him to the murder of UnitedHealthcare CEO Brian Thompson on December 4 in Manhattan.
Bodycam footage showed an officer exclaiming, “It’s him, dude. It’s him, 100%,” while veteran officer Christy Wasser displayed the magazine. This evidence was contested by Mangione’s legal team during a pretrial hearing, where they sought to prevent the use of the magazine, a 9 mm firearm, a notebook, and other personal effects found in his bag.
The defense contended that the search was illegitimate due to the absence of a warrant and insufficient cause for a warrantless search, while prosecutors maintained that the search was lawful and later obtained a warrant.
While testifying in uniform, Wasser explained that department protocols necessitate checking suspects' belongings for any hazardous items, noting that patrons were not evacuated from the McDonald’s during the search.
At 27, Mangione has entered a not guilty plea to both state and federal murder charges, exercising his right to silence. The current hearing pertains to state charges, whereas his attorneys are working to exclude evidence from the federal case, which is pursuing a death penalty sentencing.
Authorities confirmed that the handgun retrieved matched the caliber used in Thompson's murder, and notes in the notebook indicated possible plans against a CEO and expressed hostility toward health insurance companies. Surveillance footage had captured a masked shooter attacking Thompson with ammunition bearing terms such as “delay,” “deny,” and “depose,” reflecting the insurance sector's language.
Mangione's arrest stemmed from a 911 call that reported a McDonald’s patron resembling the suspect. He faced initial charges for forgery and providing a false ID after attempting to use a counterfeit driver’s license, which was stealthily linked to the primary suspect in Manhattan.
During the search of his backpack, Wasser first located ordinary items—such as a hoagie, bread, and a small bag containing a passport, cellphone, and computer chip—before discovering the gray underwear hiding the magazine. Once at the police station, she later discovered a 9 mm handgun, silencer, notebooks, and other papers seemingly outlining nefarious plans.
A judge subsequently authorized a search warrant for the bag, permitting authorities to hand over the evidence to New York investigators.
Prosecutors characterized Thompson’s murder as an “execution” and referred to the notebook as a “manifesto,” although the judge noted that such terms would not be permitted during the trial.
Mangione remains in custody as the court continues to deliberate on the admissibility of the gathered evidence.
