The US Justice Department has introduced new regulations aimed at safeguarding federal and personal data from foreign adversaries, particularly China, Iran, and Russia. This initiative, unveiled on Monday, is a response to growing concerns over the misuse of American data and forms part of an executive order signed by President Joe Biden earlier this year.
The proposal seeks to limit certain business transactions that could lead to sensitive American financial, genomic, and health data falling into the hands of foreign entities. By implementing these restrictions, the government hopes to thwart potential cyberattacks, espionage efforts, and blackmail tactics that could arise from access to this data.

In addition to targeting China, Russia, and Iran, the proposed rules extend to countries like Venezuela, Cuba, and North Korea. This move aligns with Washington’s broader strategy to control the flow of American personal information to these nations, which has been a significant issue in the ongoing trade and technology conflict.
One key aspect of the proposal is its focus on data brokers. Transactions will be prohibited with brokers who are aware that the information they manage will ultimately reach “countries of concern.” Furthermore, any transfer of data pertaining to US government personnel is strictly forbidden.
This latest proposal provides greater clarity on the specific types and amounts of data that are subject to restrictions. It explicitly mentions that transfers involving human genomic data from over 100 Americans or personal health and financial information from more than 10,000 individuals are prohibited. Additionally, the transfer of precise geolocation data from over 1,000 US devices is also banned under these new rules.
To ensure compliance, the Justice Department will have the authority to enforce these regulations through both criminal and civil penalties. Officials have indicated that popular Chinese applications, such as TikTok, could potentially violate these rules if they were to transfer sensitive data from US users to their parent company in China.
This initiative reflects the US government's intensified efforts to protect the privacy and security of its citizens amid increasing concerns over foreign surveillance and the exploitation of personal information.
