Media mogul Jimmy Lai made his way to the High Court in Hong Kong on Monday for a critical mitigation hearing before his sentencing in a prominent national security trial. The 78-year-old pro-democracy champion faces a potential life sentence after being convicted last month.
Lai, who founded the now-defunct Apple Daily, was found guilty of conspiracy to collude with foreign entities and conspiracy to distribute seditious materials under the controversial national security law. He has persistently denied all allegations.
This trial has captured global interest, drawing sharp criticism from the United Kingdom, European Union, and the United States. Nonetheless, Hong Kong officials insist the trial was conducted fairly, asserting that the national security law has restored order in the region.
During the proceedings, Lai’s defense team petitioned for a more lenient sentence. According to national security law parameters, penalties could range from a decade to life. Lai sat in a glass dock, separated from the public by prison officers alongside eight other defendants.
Prosecutors responded to concerns regarding Lai’s health, referencing a medical evaluation from January 9 that declared his condition as “stable.” Key testimonies against him came from several prosecution witnesses, including Andy Li and Wayland Chan Tsz-wah.
Lai has a long history as a critic of the Chinese Communist Party (CCP) and a staunch advocate for press freedom in Hong Kong. Judges noted that he utilized Apple Daily as a platform to campaign against the CCP, despite the risks it posed to the public interest in both Hong Kong and China.
The hearing attracted significant public interest, with nearly 100 supporters gathering outside the court, some having camped for several days. Many expressed their belief that Lai has committed no wrongdoing.
The case has also garnered international attention. Reports indicate that former U.S. President Donald Trump urged Chinese President Xi Jinping to release Lai, referring to him as a “positive activist,” though no response was received.
This mitigation hearing is crucial in determining Lai’s final sentence and may significantly impact media freedom, civil rights, and the ongoing struggle for pro-democracy activism in Hong Kong.
