Concerns surrounding the health and future of media mogul Jimmy Lai took center stage on Monday, as the High Court in Hong Kong heard the last mitigation arguments in his national security trial. This hearing serves as the final step before sentencing in a case closely scrutinized since the enactment of the national security law in the city.
At 78, Jimmy Lai is the founder of the now-dissolved pro-democracy publication Apple Daily and has been a persistent critic of the Chinese government. Last December, he was found guilty of colluding with foreign entities and publishing seditious materials, facing a potential sentence ranging from 10 years to life imprisonment. Lai has consistently denied all charges against him.
His case has provoked strong reactions from numerous nations, including the United States, the United Kingdom, and members of the EU, who express concerns over press freedoms and impartial trials in Hong Kong. Nevertheless, local officials assert that the proceedings adhered to legal standards, claiming that the national security law has reinstated order following the extensive pro-democracy protests of 2019.
During the proceedings, Lai’s legal team emphasized his age and health conditions, highlighting issues such as high blood pressure, diabetes, and cataracts. They argued that with over 1,800 days spent in solitary confinement, Lai’s physical and mental well-being have been seriously compromised, with his lawyer stating that each passing day in prison brings him closer to death, despite his ailments not being immediately life-threatening.
Prosecutors contested assertions regarding a drastic decline in Lai’s health while in custody. They referred to a medical report indicating that his condition is stable and challenged claims of significant weight loss, citing official records which reflect only minor changes. They also noted that Lai himself opted for solitary confinement for safety reasons.
The judges involved remarked that Lai effectively used his media influence to propagate views intended to undermine the Chinese government and jeopardize Hong Kong’s stability. Several co-defendants, including former executives from Apple Daily, have appealed for lighter sentences after cooperating with prosecutors and testifying against Lai.
Outside the courtroom, demonstrators displayed their support for Lai, with nearly 100 individuals queuing overnight to secure seating inside, some having waited for days. They articulated their belief that Lai faces punishment primarily due to his political beliefs and expressed hope for his release.
International scrutiny of this case continues to grow, with United Nations officials advocating for Lai’s release on humanitarian grounds, given his health and age. Recently, former U.S. President Donald Trump mentioned that he personally discussed Lai’s situation with Chinese leader Xi Jinping, labeling him as a positive activist without receiving any reply.
The hearing is anticipated to proceed, with sentencing imminent. Regardless of the verdict, the Jimmy Lai case has evolved into a significant symbol of the broader dialogue concerning freedom of expression, the rule of law, and political dissent in today’s Hong Kong.
