In a bold legal move, Chinese surveillance giant Hikvision announced that its U.S. subsidiary has filed a challenge against a new Federal Communications Commission (FCC) rule tightening restrictions on Chinese-made telecommunications equipment. The rule, aimed at mitigating national security risks, bars new approvals for devices with parts from companies on the FCC's “Covered List” and allows for revoking prior authorizations.
Hikvision argues the FCC has exceeded its authority, claiming the agency “seeks to retroactively curtain lawful authorizations without sufficient legal or evidentiary basis.” The company said its petition aims to safeguard its market rights and support a predictable regulatory environment for lawful businesses and customers.
The FCC previously included Hikvision, Huawei, ZTE, China Mobile, and China Telecom on the Covered List, effectively preventing these companies from receiving U.S. import or sales approvals for new equipment. In recent months, major online retailers removed millions of prohibited listings for items including home security cameras and smartwatches from these Chinese firms.
This is not the first time Hikvision has faced U.S. regulatory hurdles. In February, a U.S. appeals court rejected the company's attempt to lift the 2022 ban on its new video surveillance and telecom equipment. The FCC has also targeted other entities, such as Hong Kong-based HKT, over national security concerns, signaling an intensified scrutiny of foreign telecom firms.
Hikvision emphasizes that the legal action is designed to maintain market stability and protect the interests of partners and consumers in a regulatory landscape that is increasingly complex.
