Gambia has presented its case to the judges at the United Nations’ apex court, claiming that Myanmar intentionally devastated the lives of the Rohingya people, transforming their existence into a daily nightmare. This historic case at the International Court of Justice (ICJ) in The Hague accuses Myanmar of genocide against the Rohingya Muslim minority.
This marks the first full genocide legal proceedings at the ICJ in over a decade. Experts suggest that the court’s eventual ruling could significantly influence not only Myanmar but also other ongoing global genocide cases.
Gambia’s Justice Minister Dawda Jallow addressed the court, stating that the Rohingya are ordinary individuals seeking peaceful lives, yet have become targets of obliteration. Gambia alleges that the actions of Myanmar have stripped the Rohingya of safety and dignity, replacing their everyday existence with profound fear and violence.
Initially lodged by Gambia in 2019, the case centers around a military operation initiated by Myanmar in 2017 in Rakhine state. This operation reportedly necessitated the flight of at least 730,000 Rohingya to neighboring Bangladesh. Refugees recounted horrific instances of killings, systemic sexual violence, and the incineration of entire villages during their escape.
A subsequent United Nations inquiry revealed substantial evidence suggesting that Myanmar's military might have committed genocidal acts. Myanmar, however, has categorically denied these accusations, asserting that its military actions were a counter-terrorism initiative responding to assaults by Rohingya militants.
For the Rohingya survivors, these proceedings offer a long-awaited glimmer of hope. Outside the court, refugees expressed their desire for the world to acknowledge their plight. Many feel that a ruling against Myanmar would validate their suffering and aid in achieving justice after prolonged silence.
This case is also unprecedented as it enables Rohingya victims to share their narratives before an international tribunal for the first time. Their testimonies will be presented in closed sessions to safeguard their privacy but are now formally recognized in the legal framework.
Myanmar’s situation has deteriorated in recent years, particularly following the military coup in 2021, which has resulted in widespread turmoil and violence. Current elections have been condemned by the United Nations and human rights organizations for lacking fairness.
The hearings at the ICJ are set to span several weeks. While the final verdict may take time to deliver, the proceedings themselves convey a robust message: that even the mightiest nations are subject to international scrutiny, and that the plight of mass violence victims remains at the forefront.
