US Unveils Pardon Process for Veterans Convicted of Gay Sex in Military

President Joe Biden has issued a proclamation aimed at pardoning U.S. veterans who were convicted by the military for engaging in consensual homosexual activity, which was illegal until its repeal in late 2013. The Biden administration estimates that this proclamation could impact thousands of individuals who were discharged or faced consequences due to their sexual orientation or gender identity.

In a statement, President Biden highlighted the sacrifices made by LGBTQI+ service members, noting that despite their courage and dedication, many were unjustly expelled from the military because of their sexual orientation or gender identity.

Under the new proclamation, affected individuals can apply for proof of eligibility for a pardon. Those granted a certificate of pardon will then have the opportunity to request a change in their discharge characterization.

Senior administration officials emphasized the administration's commitment to reaching out to eligible individuals who may benefit from this pardon process. They underscored the significance of rectifying past injustices and ensuring that LGBTQI+ veterans receive the recognition and respect they deserve for their service.

The repeal of the military ban on consensual homosexual activity, previously defined under Article 125 of the Uniform Code of Military Justice as "unnatural carnal copulation," occurred as part of broader legislative efforts. In late 2013, the U.S. Senate passed legislation that included this repeal, subsequently signed into law by then-President Barack Obama during his tenure, with Vice President Joe Biden serving alongside him.

This initiative marks a significant step towards addressing historical discrimination within the military and honoring the contributions of LGBTQI+ individuals who have served their country with bravery and dedication.
