His Highness Sheikh Dr. Sultan bin Mohammed Al Qasimi, the Supreme Council Member and Ruler of Sharjah, has officially issued an Emiri Decree establishing a new Judicial Department in the Emirate of Sharjah. This department is designed to have its own legal personality and legal capacity, empowering it to fulfill its objectives and exercise its powers effectively. The decree emphasizes the department's financial and administrative independence while aligning it with the Judicial Council in Sharjah. Its primary responsibility will be to organize and oversee the work of all types and levels of courts and judicial services within the emirate. This initiative aims to enhance the delivery of justice and safeguard the independence of the judiciary.

To regulate the judiciary and the newly formed Judicial Department, the decree calls for the issuance of a law that will follow the established legislative procedures in Sharjah. The Emiri Decree also outlines specific transitional provisions to facilitate the establishment of the Judicial Department. Members of the judiciary, judicial assistants, and administrative and technical staff currently employed under the federal Ministry of Justice will be transferred to the new Judicial Department. This transfer will be based on decisions made by the Judicial Council, following a proposal from the department's chairperson and in line with Cabinet Resolution No. (46) of 2019.
All assets, contracts, rights, obligations, accounts, technical systems, and other resources associated with the Ministry of Justice will also be transferred to the Judicial Department. A joint committee composed of representatives from the Government of Sharjah and the Federal Supreme Judicial Council will oversee this transfer process, being responsible for reporting its findings and recommendations to the relevant higher authorities. During the transitional period, the existing judicial system in Sharjah will continue to operate under the regulations of the Ministry of Justice until the new law governing the judiciary is enacted and the transfer process is fully completed. This initiative marks a significant step in Sharjah's ongoing efforts to enhance its judicial system and promote an independent and efficient judiciary.
