In a major shift that will directly impact thousands of Indian-origin families, the Canadian government has cleared the way to end the long-criticised “second-generation cut-off” rule. Bill C-3 — the legislation aimed at modernising citizenship by descent — has officially received royal assent, marking a turning point for families whose children were denied citizenship simply because they were born abroad.
With this update, Canada is preparing to expand who can be counted as a citizen by descent, ensuring that families living across borders no longer face years of uncertainty.
Under the upcoming framework, anyone born before the law takes effect — and who would have qualified for citizenship if not for the earlier limitation — will now be granted citizenship once the bill comes into force. The change also clears the path for Canadian parents born or adopted outside the country to pass citizenship to their children born overseas, provided they maintain a meaningful connection to Canada.
The government says this “substantial connection” clause aims to support global families without weakening the value of citizenship. While the exact implementation date will be announced separately, officials have confirmed that interim measures remain active until the new law officially begins.
The old rule, introduced in 2009, had blocked children from obtaining citizenship if their Canadian parent was also born abroad. This led to widespread complications, especially among Indian-origin households, many of whom work and raise families in multiple countries. The policy was struck down by an Ontario court in 2023, prompting the government to move toward a permanent fix instead of appealing the decision.
By removing the long-standing cut-off and aligning the law with the realities of modern global mobility, Canada is now set to offer long-awaited clarity to families who have spent years navigating complex and uncertain pathways to citizenship. The change is expected to bring immediate and long-term relief once the law officially comes into force.
