In a significant legal development, UK prosecutors have announced their intention to appeal a court's decision to dismiss a terrorism charge against Liam O'Hanna, known by his stage name Mo Chara, a member of the Irish rap group Kneecap.
The case centers around an incident in November 2024, during a Kneecap concert in London, where O'Hanna allegedly displayed a flag associated with Hezbollah, a group proscribed under UK terrorism laws. In May 2025, he was charged under the Terrorism Act 2000, which criminalizes the display of articles in a manner that arouses reasonable suspicion of support for a banned organization.
However, on September 26, 2025, Chief Magistrate Paul Goldspring ruled that the case was "unlawful" and "null" because it was brought outside the six-month statutory limit for such charges. The court's decision highlighted a technical error in the prosecution's handling of the case.
The Crown Prosecution Service (CPS) has expressed its intention to appeal the court's decision, citing the need to clarify an important point of law. A CPS spokesperson stated, "We are appealing the decision to dismiss this case as we believe there is an important point of law which needs to be clarified."
Following the dismissal of the charge, O'Hanna asserted that the case was less about public safety and more about silencing dissent regarding the ongoing conflict in Gaza. He stated, "As people from Ireland, we know oppression, colonialism, famine and genocide. We have suffered and still suffer under 'your empire'. Your attempts to silence us have failed because we are right and you are wrong. We will not be silent."
Northern Ireland's First Minister, Michelle O'Neill, echoed these sentiments, describing the charges as part of a "calculated attempt to silence those who stand up and speak out against the Israeli genocide in Gaza."
The case has sparked a wider debate about the boundaries of free speech, political expression, and the application of counterterrorism laws. Critics argue that the prosecution's actions may set a concerning precedent for the criminalization of political dissent, particularly in the context of international conflicts.
Internationally, Kneecap has faced scrutiny for its outspoken support of Palestinian rights. Countries like Canada and Hungary have banned the group from entry, and some of its concerts in Germany and Austria have been canceled. Despite these challenges, Kneecap maintains that it does not support Hezbollah or Hamas and does not condone violence.
The upcoming appeal will likely bring further attention to the intersection of national security laws and freedom of expression. Legal experts and human rights advocates will be closely monitoring the proceedings, as the outcome could have significant implications for similar cases in the future.
