North Korea has once again declared its position on nuclear weapons, saying that its status as a nuclear-armed state is “permanently enshrined” in its laws and cannot be reversed. This statement came in strong response to criticism from the United States and other international voices calling for the denuclearisation of the Korean Peninsula.

According to reports, North Korea condemned the United States for what it called “grave political provocation” during a recent meeting of the International Atomic Energy Agency’s (IAEA) Board of Governors. The US had described North Korea’s nuclear weapons programme as illegal and demanded steps towards denuclearisation.

In reply, North Korea firmly rejected those calls, saying its nuclear status was written into its “supreme and fundamental law” and was not open for negotiation.

North Korea’s Official Position

North Korea’s UN mission explained in detail that the nuclear status of the Democratic People’s Republic of Korea (DPRK) has become irreversible. The statement underlined that the country has not had official relations with the IAEA for more than three decades.

It further accused the IAEA of lacking “legal authority” and “moral justification” to interfere in the internal affairs of a sovereign nuclear-armed state. The DPRK highlighted that since it exists outside the Nuclear Non-Proliferation Treaty (NPT), international organisations have no jurisdiction over its weapons programme.

Background of North Korea and the IAEA

North Korea originally joined the International Atomic Energy Agency but withdrew from the body in 1994. This was during a tense standoff with the United States over nuclear inspections. North Korea claimed at the time that the agency was being used by Washington as a tool to pressure and control Pyongyang, thereby infringing on its sovereignty.

Since that withdrawal, North Korea has carried out a number of nuclear tests and developed ballistic missiles capable of carrying nuclear warheads. Despite heavy international sanctions and multiple rounds of negotiations, the DPRK has refused to abandon its programme. Instead, it has declared nuclear weapons as the cornerstone of its defence strategy.

  • 1994 Agreed Framework: The first major attempt to limit North Korea’s nuclear activity came in 1994, when the US and DPRK signed the Agreed Framework. North Korea promised to freeze its nuclear programme in exchange for energy assistance. However, this deal collapsed in the early 2000s.

  • 2006 First Nuclear Test: North Korea conducted its first nuclear test in October 2006, marking a turning point. Since then, it has carried out multiple nuclear tests, each one more powerful than the last.

  • Six-Party Talks: Between 2003 and 2009, negotiations involving North Korea, South Korea, the US, China, Japan, and Russia attempted to resolve the issue. These talks eventually broke down, largely due to disagreements over verification and sanctions relief.

  • Recent Developments: In the past decade, North Korea has advanced missile technology, testing long-range missiles that could potentially reach the United States. Despite high-profile summits with former US President Donald Trump, no concrete agreements were achieved.

North Korea’s View of the IAEA

North Korea holds a deep mistrust of the IAEA. According to Pyongyang, the agency is not a neutral international body but an organisation heavily influenced by Washington and its allies. The latest statement repeated this position, dismissing the IAEA’s criticisms as interference.

The DPRK argues that since it left the NPT, it is not bound by the treaty’s restrictions. Therefore, it does not recognise the authority of the IAEA or its Board of Governors in judging the legality of its nuclear weapons.

The United States and its allies see North Korea’s nuclear programme as a direct threat to international peace and security. Washington has consistently maintained that a nuclear-armed North Korea is unacceptable.

American officials argue that North Korea’s weapons could destabilise the region, spark a nuclear arms race, and increase the risk of conflict. The US has also warned that North Korea might share nuclear technology with other states or non-state actors, creating global security concerns.

South Korea and Japan’s Concerns

South Korea and Japan, both close neighbours of the DPRK, remain particularly alarmed. For South Korea, North Korea’s claim makes reunification or peaceful coexistence more complicated, since nuclear weapons pose an existential threat. Japan, which has long been within the range of North Korean missiles, is also stepping up its defence policies, including closer cooperation with the US.

China and Russia’s Role

China and Russia, both neighbours and traditional partners of North Korea, have often played mediating roles. However, they too have expressed unease about nuclear proliferation. Still, both countries oppose excessive pressure on Pyongyang, arguing that dialogue and security assurances are more effective than sanctions.

North Korea’s new declaration may further complicate Beijing and Moscow’s diplomatic balancing act.
