In a significant legal setback for former President Donald Trump, a federal judge has ruled that his deployment of National Guard troops to Portland, Oregon, was unlawful. The decision, handed down by U.S. District Judge Karin Immergut on November 7, 2025, permanently blocks Trump’s use of military force to suppress protests at immigration facilities.
Judge Immergut, herself a Trump appointee, rejected the administration’s claim that the protests amounted to a “rebellion” that would legally justify sending in troops. The ruling replaces an earlier temporary order that had already paused the deployment in October.
The Trump administration had argued that federal agents in Portland were under siege from violent demonstrators, echoing the former president’s characterization of the city as “war-ravaged.” However, lawyers representing the City of Portland and the Oregon Attorney General countered that incidents of violence were rare and largely contained by local law enforcement.
Court records show that since the protests began in June, 32 individuals have been charged with federal offenses related to the demonstrations. Of those, 11 pleaded guilty to misdemeanors, while others received probation. Serious acts, such as an attempted knife attack on an officer, remain isolated exceptions. Most charges involved minor assaults, such as shoving, kicking, or throwing objects, resulting in only minor injuries to federal officers.
The ruling comes amid Trump’s broader attempts to deploy military forces in Democrat-led cities including Los Angeles, Chicago, and Washington D.C. Legal experts note that the decision underscores the longstanding principle that the use of military forces on U.S. soil is reserved for extreme emergencies such as invasions or armed rebellions—not localized civil unrest.
With the Trump administration expected to appeal, the case could ultimately reach the U.S. Supreme Court, potentially shaping the legal boundaries of military authority in domestic protests for years to come.
