Israeli officials are particularly concerned about the prospect of arrest warrants targeting top government figures, including Netanyahu, for alleged violations of international humanitarian law in Gaza. They are also wary that Hamas leaders could face similar charges.

Israel, not being a member of the ICC, does not recognize its jurisdiction. However, the Palestinian territories were granted membership in 2015, allowing the ICC to investigate crimes committed within its jurisdiction. ICC Chief Prosecutor Karim Khan has asserted the court's jurisdiction over potential war crimes committed by both Hamas fighters in Israel and Israeli forces in Gaza. Khan has pledged to hold those responsible for breaches of international law accountable.
The United States, Israel's ally, also does not recognize the ICC's jurisdiction in this matter. U.S. Ambassador to the U.N. Linda Thomas-Greenfield has emphasized the ICC's independence in its investigations. While the U.S. does not support the ICC's inquiry, it maintains that the court's decisions should not be influenced by external factors.
If arrest warrants are issued, individuals named would face restrictions on travel, as they could be detained in ICC member countries. This could lead to increased international isolation for Israel, as allies may limit diplomatic engagements or arms transfers in response. The situation has further implications for the ongoing conflict, with potential ramifications for peace negotiations and humanitarian efforts in the region.
