The Public Prosecution in Abu Dhabi has issued a stern warning against the unauthorized collection of donations, emphasizing the legal consequences outlined in Article 46 of Federal Decree-Law No. (34) of 2021 on Combating Rumours and Cybercrimes. This law specifically addresses individuals or entities who establish, manage, or operate websites or disseminate information online to solicit or endorse fundraising activities without obtaining the necessary license from the competent authority. In an effort to raise awareness about the legal ramifications of such actions, the Public Prosecution released an educational video across its social media platforms.

According to the provisions outlined in the law, individuals found guilty of engaging in unauthorized fundraising activities may face severe penalties, including imprisonment and substantial fines. Specifically, offenders could be subjected to imprisonment and fined an amount ranging from Dh200,000 to Dh500,000, or a combination of both penalties. These penalties serve as a deterrent against illicit fundraising practices and underscore the importance of obtaining proper authorization from regulatory authorities before soliciting donations through online platforms or any other information technology means.

The Public Prosecution's proactive measures in disseminating information about the legal consequences of unauthorized fundraising aim to safeguard the public from falling victim to fraudulent schemes and ensure compliance with regulatory requirements. By raising awareness about the legal framework governing fundraising activities, authorities seek to protect the interests of both donors and the broader community. Furthermore, the stringent enforcement of laws related to fundraising underscores the commitment of the UAE government to combatting financial crimes and preserving the integrity of charitable endeavors.

In light of the increasing prevalence of online platforms as avenues for fundraising, regulatory oversight becomes essential to maintain transparency, accountability, and trust in charitable activities. Through educational initiatives and enforcement measures, the Public Prosecution aims to promote responsible fundraising practices and prevent exploitation or misuse of charitable funds. Moreover, by holding violators accountable under the law, authorities send a clear message about the seriousness with which they address financial misconduct and cybercrimes in the digital age.

Overall, the warning issued by the Public Prosecution serves as a reminder of the legal obligations and ethical considerations associated with fundraising activities in the UAE. It underscores the importance of adherence to regulatory guidelines and the necessity for individuals and organizations to obtain proper authorization before engaging in fundraising endeavors. By upholding the rule of law and promoting transparency in charitable activities, authorities strive to foster a culture of compliance and integrity within the philanthropic sector, ultimately benefiting society as a whole.
