Spain to Support South Africa's Gaza Genocide Case at ICJ

Spain has declared its intention to support South Africa's case against Israel at the International Court of Justice (ICJ), alleging violations of the Genocide Convention in Israel's Gaza conflict. Spanish Foreign Minister Jose Manuel Albares announced the decision, citing ongoing military operations in Gaza and the escalating regional conflict as primary concerns. Albares emphasized Spain's commitment to restoring peace in Gaza and the wider Middle East, as well as its dedication to upholding international law.

The decision to join South Africa's case aligns with Spain's recent actions, including its recognition of the state of Palestine alongside Ireland and Norway. This move drew criticism from Israel, which accused the countries of "rewarding terrorism" and subsequently withdrew its ambassadors. Despite this, Spain remains steadfast in its pursuit of a peaceful resolution and the advancement of a two-state solution.

South Africa initiated the case against Israel in January, accusing it of genocide against Palestinians in Gaza. The death toll from Israel's offensive in Gaza, which commenced in October, has surpassed 36,500 according to health officials in the besieged territory. Israel launched the assault in response to attacks by Hamas, resulting in significant casualties.

While the ICJ will ultimately decide the case's merits, it may take several years before a ruling is reached. Although ICJ rulings are binding, enforcement mechanisms are limited. Israel has consistently maintained that its actions in Gaza comply with international law, dismissing the genocide allegations as unfounded and criticizing South Africa's involvement as supportive of Hamas.

With Spain's decision to join the case, it joins several other nations, including Colombia, Egypt, and Turkey, in formally seeking involvement in the proceedings against Israel.
