Spain to support South Africa in UN court against Gaza "genocide".

Madrid: Spain announced on Thursday its decision to support South Africa's case at the UN's top court, where Pretoria has accused Israel of "genocide" in the Gaza Strip. Foreign Minister Jose Manuel Albares stated during a press conference that Spain's primary objective is to end the conflict and progress towards implementing the two-state solution.

The announcement comes just a week after Spain, along with Ireland and Norway, formally recognized the state of Palestine, a move that sparked strong objections from Israel.

South Africa initiated the case against Israel at the International Court of Justice (ICJ) last year, alleging that Israel's military offensive in Gaza, launched in response to a significant Hamas attack on Israel, violated the 1948 UN Genocide Convention. Israel vehemently denied these allegations.

Established after World War II, the ICJ resolves disputes between nations. In a ruling on January 26, the ICJ instructed Israel to ensure "unimpeded access" for UN-mandated investigators to examine claims of genocide and to take all possible measures to prevent genocide during its military operation in Gaza.

Despite this, South Africa continued to press the ICJ, arguing that the dire humanitarian situation in Gaza warranted additional urgent measures. On May 24, the court ordered Israel to immediately cease its military offensive in Rafah and maintain open access to the key border crossing for humanitarian aid without hindrance. Additionally, it demanded the unconditional release of hostages held by the Palestinian group Hamas following their October 7 attack that triggered the conflict.

Although ICJ rulings are legally binding, the court lacks concrete enforcement mechanisms. For instance, it previously ordered Russia to halt its invasion of Ukraine, but these directives were not heeded.
