Meta has announced it will withhold the release of its upcoming multimodal AI model, Llama, and any future models in the European Union due to what it describes as regulatory uncertainty. This decision reflects a broader trend among US tech firms opting to delay product launches in Europe amid unclear regulations.
The Llama AI model is designed to process video, audio, images, and text, intended to enhance products such as smartphones and Meta's Ray-Ban smart glasses. However, European consumers and businesses will not have access to these advanced AI capabilities, as Meta cites the unpredictable regulatory landscape in Europe as the primary reason for this decision. This move follows Apple's recent decision to postpone the rollout of its Apple Intelligence features in Europe for similar regulatory concerns. The Irish Data Protection Commission, Meta's lead regulator in Europe, has yet to comment on the matter.
The implications are significant: European companies will miss out on Meta's cutting-edge AI technologies, and non-EU companies may also face challenges offering products in Europe that rely on these advanced AI models. In contrast, Meta plans to proceed with the release of a larger, text-only version of the Llama 3 model, which will be available to customers and businesses within the EU.

Meta's primary regulatory hurdle pertains not to the upcoming AI Act but to compliance with the General Data Protection Regulation (GDPR), particularly concerning how AI models are trained using data from European users. In May, Meta announced its intention to utilize publicly available posts from Facebook and Instagram to train future models, informing over 2 billion EU users about their right to opt out. However, following public disclosure of these plans, Meta was instructed to halt training on EU data and faced extensive queries from data privacy regulators.
Interestingly, the United Kingdom, which maintains regulations similar to GDPR, has not posed the same level of uncertainty. Meta intends to proceed with launching its new model for UK users without hindrance. A Meta spokesperson noted that European regulators tend to lag in interpreting existing laws compared to other global regions.
This situation underscores the escalating tensions between US tech giants and European regulatory authorities. The EU is renowned for its stringent privacy and antitrust regulations, which tech companies argue may hinder innovation and global competitiveness. Meta emphasizes the necessity of training AI models on European data to ensure products accurately reflect regional terminology and cultural nuances. The company also points out that competitors like Google and OpenAI are actively training AI models using European data, intensifying competitive pressures in the market.
