Italy is on the verge of adopting a decree aimed at addressing court objections to its controversial plan for migrant detention camps in Albania. This initiative, intended to deter migrants arriving by sea from North Africa, has faced significant legal challenges since its announcement last week.
On Friday, a court in Rome ruled that the first group of migrants transported to Albania must be returned to Italy. The ruling stated that migrants from Egypt and Bangladesh cannot be sent to Albania, as these countries are not deemed safe. This decision raised serious concerns about the viability of Italy's strategy to establish offshore migrant reception centers in a non-EU state, igniting a heated conflict between Prime Minister Giorgia Meloni's right-wing government and the judiciary.
The court's decision referenced a recent ruling from the European Court of Justice, which established that a country outside the EU cannot be classified as safe unless its entire territory is deemed free from danger. In response to this legal setback, the Italian government intends to revise its list of "safe countries," which currently includes Egypt, Bangladesh, and 20 other nations. A source close to the matter indicated that the updated list would be incorporated into legislation rather than merely relying on a ministerial decree.

The cabinet is scheduled to convene at 1600 GMT to discuss and potentially approve the decree. However, its effectiveness remains uncertain, with constitutional law professor Salvatore Curreri from Enna Kore University expressing skepticism about whether this measure would successfully prevent judges from rejecting future requests to detain migrants in Albania.
This legal struggle reflects broader tensions within Italy regarding migration policy and the complexities of international law in relation to human rights and safety standards for migrants.
