German authorities have arrested five men suspected of committing war crimes and crimes against humanity in Syria approximately a decade ago, according to prosecutors. The suspects, identified only as Jihad A., Mahmoud A., Sameer S., Wael S., and Mazhar J., were detained under Germany’s universal jurisdiction laws, which enable the prosecution of serious international crimes regardless of where they were committed.
Jihad A., Mazhar J., and Sameer S. were apprehended in Berlin, Mahmoud A. in Frankenthal, Rhineland-Palatinate, and Wael S. in Mecklenburg-Vorpommern. The suspects are believed to have been affiliated with the Free Palestine Movement militia in Syria, with Mazhar J. additionally suspected of being a Syrian Intelligence Officer.
Prosecutors allege that the individuals are strongly suspected of killing and attempting to kill civilians, actions that qualify as crimes against humanity and war crimes. Specifically, they are accused of participating in a violent crackdown on a peaceful anti-government protest in Al Yarmouk in July 2012, where six civilians were killed and many others injured by gunfire.
Between 2012 and 2014, the suspects are also accused of physically assaulting civilians at checkpoints, using fists, rifle butts, and other means to beat them. Additionally, one suspect allegedly handed over a detainee to the Syrian Military Intelligence Service, where he was imprisoned and tortured. Another is suspected of having identified three individuals executed in a mass killing of 41 civilians in April 2013.
The arrests were part of a coordinated investigation with Swedish authorities, who have also arrested three individuals in Sweden for similar crimes committed in Syria in 2012. This collaboration underscores the effectiveness of international legal mechanisms in addressing atrocities committed abroad.
