Families of Victims from Boeing Crashes Prepare to Face Company in Court

Relatives of some of the 346 individuals who lost their lives in two crashes involving Boeing 737 Max planes are set to appear in court on Friday. Their lawyers will urge a federal judge to reject a plea agreement reached between Boeing and federal prosecutors. The families are advocating for a trial against Boeing, seeking a more stringent punishment for the company.

In July, Boeing agreed to plead guilty to a single felony count of conspiracy to commit fraud linked to securing regulatory approval for the 737 Max. The settlement, which was reached with the Justice Department, stipulates that Boeing—a major government contractor—will pay a fine and undergo probation.

Family members have described the agreement as a “sweetheart deal” that does not adequately address the loss of their loved ones. Erin Applebaum, a lawyer representing some of the victims’ families, expressed the sentiment of many, stating, “The families who lost loved ones in the 737 Max crashes deserve far more than the inadequate, superficial deal struck between Boeing and the Department of Justice. They deserve a transparent legal process that truly holds Boeing accountable for its actions.”

In defense of the settlement, lawyers representing the government and Boeing have submitted court briefs. On the other side, the families’ lawyers have outlined their objections to the agreement. US District Judge Reed O'Connor will hear arguments from both sides during the hearing, which will take place in Fort Worth, Texas.

Should the judge accept Boeing’s guilty plea, he will also need to approve the agreed-upon sentence, as he is not permitted to impose different terms. It remains unclear when Judge O'Connor will issue a decision regarding the plea agreement.

The controversy surrounding Boeing stems from accusations that the company misled regulators by advocating for minimal, computer-based training for pilots operating the 737 Max. Boeing aimed to avoid the requirement for flight simulator training, which would have increased operational costs for airlines. 

The Justice Department contends that conspiracy to defraud the government is the most serious charge that can be substantiated, but prosecutors acknowledge that they cannot prove Boeing’s actions directly caused the crashes that occurred in 2018 in Indonesia and 2019 in Ethiopia.

Under the terms of the plea agreement, Boeing, headquartered in Arlington, Virginia, is required to pay a minimum fine of $243.6 million, invest $455 million into compliance and safety initiatives, and remain on probation for three years.
