Dubai Residents Battle to Save Life Savings in Property Dispute

After residing in a rented apartment for four decades, MK nurtured the dream of securing a permanent home for his family. Born and raised in the UAE, this expat embarked on extensive research before settling on a Dh4-million property in Falconcity of Wonders, specifically the Eastern Residence. Despite investing Dh1.6 million in the property, his aspirations now hang in the balance.

MK is not alone in his plight. Hundreds of individuals in Dubai who invested in the same project find themselves on the brink of losing their homes and life savings. This unfortunate turn of events stems from a legal dispute between Falcon Properties and Dubailand (LLC), resulting in the auction of plots on which homes were constructed.

Over 20 distressed investors, including MK, approached Khaleej Times, seeking a platform to voice their concerns and pursue justice. MK, in particular, expressed the anguish of being unable to provide answers to his family about the fate of their new home. The investors, unaware of the behind-the-scenes legal conflict, continued making payments, trusting in the progress of their property acquisition.

The Falconcity of Wonders project, launched in 2005 at Dubailand, promised a unique mixed-use development incorporating commercial, residential, and entertainment facilities. The project, featuring wonders from around the world such as the Pyramids, Taj Mahal, and Leaning Tower of Pisa, faced delays but witnessed the completion of the Western Residence.

In 2021, amid the global recovery from the Covid-19 pandemic, there was a surge in demand for spacious living areas, with villas becoming highly coveted properties. Responding to this demand, Falconcity enthusiastically launched the sale of the Eastern Residence. Unbeknownst to buyers, a prolonged dispute over unsettled dues existed between Falconcity and Dubailand.

Dubai Courts documents, disclosed by Khaleej Times, revealed that Falconcity was ordered to pay Dubailand Dh1.3 billion in October 2020. Failing to comply led to the official seizure of the developer's property in the Wadi Al Safa 2 area in January 2021. The Dubai Land Department (DLD) warned of auctioning the property if the debt remained unpaid within 15 days. In July 2023, the property was notified for auction, and in October 2023, the court ruled in favor of Dubailand LLC.

Despite the ongoing legal dispute, Falconcity's sales team proceeded to sell over 400 villas to unsuspecting homebuyers. Buyers, from first-timers to seasoned investors, were drawn in by the project's appeal, unaware of the underlying issues. Large hoardings along major highways and prominent displays at property fairs heightened the project's visibility.

Buyers like Abu Ahmad, DK, and NK now find themselves seeking answers and grappling with the disheartening reality that their dream homes may be in jeopardy. They recount assurances from real estate agents about Falconcity's reputable standing, leading them to invest substantial sums.

As the situation unfolded, it became apparent that plots were not being registered due to the ongoing court case. Despite reassurances from brokers and sales managers, concerns escalated. The eventual revelation of the auction further devastated buyers like MK, whose dreams were shattered upon seeing an advertisement announcing the auction of their purchased land.

In the face of this crisis, buyers have been met with ambiguity and broken promises. Several, like Bibi, DG, and CD, recount their journeys of investment, trusting in good faith, only to be left feeling cheated and betrayed. The lack of transparency from Falconcity has fueled frustration, leaving buyers grappling with legal complexities.

Efforts to seek clarity from Falconcity's sales team proved futile, with confidentiality clauses cited as a barrier to information disclosure. Investors turned to the Falconcity head office, but instead of addressing concerns, they were met with police intervention.

Amid the affected investors, 18 are title deed holders who have paid 100% to the developers and have their properties registered with the Dubai Land Department (DLD). Despite holding legal recognition as property owners, their homes faced auction due to the court ruling in favor of Dubailand LLC.

The Dubai Land Department, when approached for clarification, emphasized its adherence to court directions and refrained from commenting on cases within the judicial authorities' purview.

Faced with financial losses and uncertainty, investors have filed more than 50 cases with the Dubai Holding Judicial Committee (Lagna). The final verdict is anticipated on March 18, offering a glimpse of hope for MK and others navigating the complexities of legal battles.

As MK grapples with the aftermath, he shares the financial strain of resorting to a Dh65,000 loan on a credit card to fund his legal pursuit. The investors, including those holding title deeds, find solace in their belief that the court and the judicial system hold the key
