A Dubai-based company manager has been fined Dh100,000 by a court for defrauding the Nafis program, with the Dubai Public Prosecution referring the case to court, accusing the manager of violating Emiratisation rules.
The charges against the company manager include employing two female Emiratis and utilizing two work permits for a purpose other than intended for their issuance. Allegedly, the facility used fraudulent contracts to falsely demonstrate compliance with Emiratisation rules, seeking to qualify for government support through the Nafis program.
The two Emirati women worked in the private firm for only four months, reportedly with the primary intention of obtaining the monthly government support of Dh5,000.
The court, in response to the charges, ruled to impose a penalty of Dh100,000 on the manager. Importantly, the fine will be multiplied by the number of workers involved in the fraudulent scheme. Additionally, the court ordered the two employees to return the sum of Dh20,000.
Recent inspections conducted by the Ministry of Human Resources and Emiratisation (MoHRE) found that 1,077 private companies engaged in faking Emiratisation in the UAE since the second half of 2022.
The ministry penalized these firms for hiring 1,818 citizens who were proven to have violated laws by attempting to overcome targets through the illegal hiring of Emiratis.
Emiratisation is deemed fake when it is confirmed that a UAE national holds a nominal job without genuine tasks to meet the establishment's Emiratisation targets, or when an Emirati is rehired in the same establishment to manipulate data and benefit from relevant Emiratisation advantages.
Penalties for violating the law range from a hefty fine of Dh20,000 to Dh100,000 for each case, with referral to the Public Prosecution based on the severity of the violation.
MoHRE emphasized that fake Emiratisation constitutes a clear violation of Emiratisation-related decisions and the regulations of the Nafis program. Reporting any violations related to Emiratisation can be done through MoHRE's call center at 600590000 or the Ministry's smart application.
